On 2nd October the next edition of Minkner & Partner Newspaper MALLORCAS TRAUMIMMOBILIEN will be published with articles written by experts concerning everything to do with property. The 64 page newspaper will appear as a supplement in the MALLORCA ZEITUNG and will also be distributed in Mallorca’s luxury hotels, golf clubs and luxury brand shops. 2. Mallorca – Construction, Economy laws and taxes

 

(1) Construction

 

Palma/Molinar: Port expansion project remains controversial

 

The first draft of the plans for the extension of the port of Molinar – situated just east of Palma- was met with fierce opposition from both local residents and environmentalists and as a result has found few supporters in the political world. A new revised plan has now been drawn up. Instead of 315 moorings there will be a total of 220 however this proposal has also come up against opposition. Any expansion would mean that the character of the district will be fundamentally changed and the ocean currents will be affected, which is detrimental for the fishing industry. The project is calculated at nine million Euros.

 

Manacor: The industrial estate on the access road to be extended

 

The industrial estate on the access road to Manacor will be extended in order to accommodate both national and international corporate chains who will establish themselves there.Big brand companies such as Leroy Merlin, Decathlon and Mc Donalds have expressed an interest in setting up offices there so existing buildings must be renovated. The costs will be borne by the landowners. However, there were previously plans, to establish large chains there, which were met with negativity but now the idea is well received. The necessary restructuring costs are estimated at only € 700,000.

 

Felanitx: Plans for converting the Es Sindicat bodega in Felanitx into a cultural centre are called off for the moment

 

What was once the largest bodega in Mallorca, the Es Sindicat bodega in Felanitx, whose buildings are of both cultural and historical interest, will be left to fall into decay. There were big plans for the bodega: A cultural centre was to be opened their under the supervision of the world renowned artist Miquel Barcelo. Barcelo intended to make his own sculptures and paintings available to the centre. Unfortunately due to bureaucratic hurdles these plans have now come unstuck. The actual boundaries of the property could not be determined neither via the sales documents, the cadastral information nor the land registry. The verification process proved to be too complex for the local authorities.

 

(2) Economy

 

Sea salt export has increased by 500 %

 

Sea salt has developed into a best seller for Mallorca. Sales for the year have increased by 500 % so that the total annual turnover is expected to account for 100 million Euros. The main client is Germany. The export of salt is now greater than that of leather goods which has suffered significant losses. Exports from the Baleares amount to a total of 400 million Euros in the first half of 2014.

 

Port d’Alcudia will be used more by cruise ships

 

Port d’Alcudia is ever more interesting for cruise ship companies. The mayoress Coloma Terrasa announced in Barcelona’s tourist fair, that she is expecting cruise ship business in the Port of Alcudia to double in 2015. Five ocean liners had already booked berths. The community expects to see a significant recovery of the economy owing to cruise tourism and will, after hearing Terrasa’s words, do everything to make the harbour more attractive for international tourists.

 

(3) The law, taxes and finance

 

European Court of Justice (ECJ): Spanish inheritance tax for non residents is contrary to European law

 

At last non-residents who have inherited Spanish property can have the last laugh, owing to a decision made by the European Court of Justice. The Spanish Treasury are worried as they are under threat of having to make repayments for great sums of money. Behind the decision of the ECJ on 3rd Sept 2014, is the often complained about situation that non-resident heirs of Spanish property are taxed according to the central Spanish legislation (which means that amounts of €800,000 and upwards are taxed at 34 %) while residents, according to the tax laws of the individual autonomous regions, are taxed at a reduced rate – mostly 1 %. In short: autonomous regions have actually eliminated the inheritance tax – elimination by trivialisation.

 

In 2007 the European Commission unsuccessfully asked Spain to change the tax to avoid it being so discriminatory against non residents in Spain. The ECJ considered that this type of taxation is also an aggravating factor because it reduces the value of any estate or the effect of a donation.

 

The Spanish tax authorities have not yet commented on the ruling and could be obliged to refund excess taxes paid. The general rule is that there is a period of limitation of four years from the date that the tax was paid. Spain is possibly not to be relied on due to the sluggish process of the statute of limitations. Those who have paid inheritance in excess in the last few years should seek the help of a lawyer or tax expert in order to initiate their claim for a refund.

3. MinknerArt Gallery& Culture

 

‘I can do that‘ – 10 self taught artists will exhibit their work in the Minkner Art Gallery in Santa Ponsa

 

They have been successful in their own fields as architects, consultants, teachers, foreign correspondents, medical assistants and craftsmen, however after retiring from their professions they chose to improve their artistic vein and so enrich their lives. Ten self taught artists will exhibit their works in the Minkner Art Gallery from the 29th Aug to 2nd Oct 2014. The participating artists are: Ana Maria Borchers, Freeman, Volker L. Hantelmann, Dr. Jens Martin Jacobi, Regine Kempf, Wilfried Lachermair, Paula Meyer, Helga Otto, Irmgard Rincke und Gisela Wartenberg. Our visitors can expect anextraordinary exhibition featuring the works of extraordinary artists, who will of course be present.

 

Brigitta Nottebohm „ART LIGHTS UP“

 

Brigitta Nottebohm was born in Salzburg, and studied in the art academy in Vienna and then as a student travelled through Italy, France, and Spain and then later New Mexico, Arizona and Los Angeles and since 1984 has been living between Mallorca and Münich. Since 1987 she has built her atelier on Mallorca.After earlier photorealistic images she has now dedicated herself to the conquest of new spaces, of light and its refraction through the matter and the landscape. There was a series of pictures entitled "SPACE LIGHT LANDSCAPE". In another series of paintings "PANTA RHEI" the artist dealt with the theme of constant change - being as eternal dynamic change. On large-scale wood or canvas surfaces, relief structures and pigments are applied creating abstract paintings that generate the tactile reliefs and the application of colour depth and dynamics. The picturesque and compositional openness conveys memories of nature scenes. Presently Brigitta Nottebohm paints large-scale, abstract paintings. Red and gold is artfully applied in infinitely many nuances in superimposed colour and image layers. Underlying swatches are only hinted at, and ultimately for the viewer to guess. By using pure pigments Birgitta Nottebohm creates remarkably energetic, radiant paintings.

Diego Arango Arango, Hanne Holze – the naive send their regards

 

Originally naïve art was a group of untrained people who presented their dreams of an ideal world. Most of their works represented rural life, but from this a modern art movement has developed which is identified by a childish representation. The Minkner & Partner art gallery has put together an exhibition of two international artists. Diego Arango Arangowas born in Columbia but has lived on Mallorca since 1988. He paints in a naïve style that brings together symbols and dreamlike images. On the current art scene he is classed as the ‘sophisticated naïve artist’. Hanne Holzehas lived on Mallorca since 1998. She observes people and parodies them in her paintings- always positive, benevolent, loving and carefree characters that are perfectly rotund with sometimes strange anatomies.

Johannes, Dagmar Adamski, Karin Darby – let the flowers speak

 

The Minkner Art Gallery in Llucmajor also presents a collective exhibition of German artists, who have in their own way dedicated them to still life and collectively have created a lush bouquet in our estate agents. Johannesthe pop-artist who paints flowers in bold colours, sensitive Dagmar Adamski and meticulousKarin Darby. Catherine Treutler is at home in all the concert halls of the world. As a soloist she has performed with the Royal Stockholm Philharmonic Orchestra, the Tokyo Philharmonic Orchestra, the Armenian Philharmonic Orchestra, the Philharmonic Orchestra of Erfurt, the Karlovy Vary Symphony Orchestra and many others. 27, 28 and 29 October 2014, Fiesta del Cine, cinema visit for € 2.90

 

From 27th – 29th Oct throughout Spain - and so Mallorca – the Fiesta del Cine will take place for the 7th time. The event will take place in numerous cinemas, such as the Sala Augusta in Palma, the Multicines in Porto Pi, the Ocimax and Multicines in Manacor. It is hoped to create interest once more in the cinema. Last year, 1.8 million spectators attended the Fiesta de Cine. Moviegoers pay during the Fiesta only € 2,90 entrance fee per film.
